Terms of Service

Agreement to Terms

These Terms of Service (“Terms”) form a binding agreement between you and RevenueSensor (“RevenueSensor,” “we,” “us,” or “our”) and govern your access to and use of our website, beta program, APIs, and product (collectively, the “Service”).

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you and that organization. If you do not agree to these Terms, please do not use the Service.

Eligibility

The Service is intended for businesses. You must be at least 18 years old and able to form a legally binding contract. You must not be barred from using the Service under applicable law (including export controls or sanctions).

Accounts & Workspaces

To use most features you'll create an account and a workspace. You agree to provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for all activity that occurs under your account.

Workspace admins can invite collaborators, manage roles, and revoke access. The workspace owner is responsible for the actions of users they invite.

Beta Services

Parts of the Service may be labeled “beta,” “preview,” “experimental,” or similar (“Beta Services”). Beta Services are provided as-is for evaluation. They may change, break, or be removed at any time, and they are not subject to any service-level commitments.

We may use information about your use of Beta Services to improve them. You agree to provide reasonable cooperation and feedback during the beta period.

Connected Platforms

The Service connects to third-party ad networks and revenue sources (such as Google Ads, Meta Ads, TikTok Ads, Apple Search Ads, AdMob, App Store Connect, Google Play, RevenueCat, Unity LevelPlay, and Meta Audience Network) on your authorization. Your use of those platforms remains subject to their own terms.

You represent that you have the right to authorize RevenueSensor to access the accounts you connect, and to import the data we receive from them.

Your Data & Our License

You retain all rights to the data you or your connected platforms provide to the Service (“Customer Data”). You grant RevenueSensor a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Customer Data solely to provide, secure, and improve the Service for you.

We may use aggregated and de-identified data — data that cannot reasonably be used to identify you, your users, or your apps — to operate, analyze, and improve the Service and to publish benchmarks. We do not sell Customer Data.

Acceptable Use

You agree not to, and not to permit anyone else to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law.
• Interfere with the Service's integrity, security, or performance, or probe it for vulnerabilities without authorization.
• Use the Service to build a competing product, to benchmark for a competitor, or to resell access without a written agreement.
• Upload data you do not have the right to provide, or use the Service to violate any law or third-party right.
• Send spam, malware, or otherwise abusive content through the Service.

Fees & Billing

Beta access may be offered free of charge. Paid plans, if any, will be presented before purchase and billed as described at checkout. Fees are non-refundable except where required by law or as explicitly stated.

Taxes are your responsibility. If we are required to collect tax, it will be added to your invoice. You authorize us (or our payment processor) to charge your designated payment method for amounts owed.

Intellectual Property

The Service, including its software, design, content, and trademarks, is owned by RevenueSensor or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. All rights not expressly granted are reserved.

Feedback

If you provide suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use it for any purpose without restriction or obligation to you.

Third-Party Services

The Service may interoperate with or link to third-party services. We are not responsible for those services, and your use of them is governed by their own terms and privacy policies.

Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data shown will be perfectly accurate.

Limitation of Liability

To the maximum extent permitted by law, RevenueSensor and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, business, goodwill, or data, arising out of or related to these Terms or the Service, even if advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the fees you paid to us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD $100.

Indemnification

You will defend, indemnify, and hold harmless RevenueSensor and its affiliates from any third-party claim arising out of or related to (i) your Customer Data, (ii) your use of the Service in violation of these Terms or applicable law, or (iii) your violation of any third-party right.

Suspension & Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service would expose us to material risk. We will generally try to notify you first when practical.

Upon termination, your right to use the Service ends. Sections that by their nature should survive — including ownership, disclaimers, liability limits, and dispute provisions — will survive.

Governing Law

These Terms are governed by the laws of the jurisdiction in which RevenueSensor is established, without regard to its conflict-of-laws principles. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. The “Last updated” date at the top reflects the most recent revision. Your continued use of the Service after changes take effect means you accept the updated Terms.
